LEARN ABOUT 2024 JACKSONVILLE BEACH CHARTER AMENDMENTS

The Jacksonville Beach City Council has placed 2 Charter amendments on the November 5 ballot to correct some issues in the current Charter. Jacksonville Beach voters are encouraged to read the language of each Charter amendment and understand each amendment before you vote. To read the the Charter amendments: CLICK HERE

To help you better understand each amendment, please review the below summary and notes about each amendment.

Amendment Number 1: Eliminating all gender references associated with job descriptions or duties in the City Charter.

Note: Currently, the City Charter refers to the Mayor, City Manager and City Attorney as “he” or “him”. This Charter amendment will remove all references to “he” and “him” and use terms that don’t reference gender in all Charter references. For example, the Charter currently states:

Section 4. – Mayor; duties and powers.

There is hereby created the office of mayor of the City of Jacksonville Beach, who shall be nominated and elected as above provided. He shall have all the powers and functions of a council member of the City of Jacksonville Beach, and shall also have the powers and perform the duties conferred and imposed upon him by this Charter and the ordinances of the city.

If approved, the Charter amendment will correct this section of the Charter (and all other similar references) as follows:

Section 4. – Mayor; duties and powers.

There is hereby created the office of mayor of the City of Jacksonville Beach, who shall be nominated and elected as above provided. The mayor shall have all the powers and functions of a council member of the City of Jacksonville Beach, and shall also have the powers and perform the duties conferred and imposed upon the office by this Charter and the ordinances of the city.

Amendment Number 2: Eliminating an existing discrepancy in the City Charter to make it clear that if a vacancy occurs in the office of the mayor, the mayor pro-tem shall act as mayor for the unexpired term.

Note: This Charter amendment will correct a conflict that exists in the Charter about filling a vacancy in the Mayor’s position in the event of a vacancy. For many years, the Charter has specified that the Mayor Pro Tem will fill a vacancy in the office of the Mayor for the unexpired term of the Mayor. However, it was recently discovered that there was conflicting language that existed in the section of the Charter on filling vacancies. This Charter amendment will remove the conflicting language in the section on vacancies.

Here is the section of the Charter that specifies the Mayor pro-tem will fill a vacancy in the office of the Mayor:

Section 5. – Mayor pro-tem.

At its first meeting following a regular municipal election and certification by the Supervisor of Elections, the council shall choose from its membership a vice-chairman who shall have the title of mayor pro-tem. If a vacancy occurs in the office of mayor, or in case of his absence or disability, the mayor pro-tem shall act as mayor for the unexpired term, or during the continuance of the absence or disability. Whenever the mayor pro-tem succeeds to the office of mayor for the remaining portion of an unexpired term, it shall create a vacancy in the council, which vacancy shall be filled in accordance with the provisions of this Charter.

Here is the conflicting language that will be removed by the Charter amendment:

Section 23. – Vacancies.

Should any vacancy occur in the council or in the office of mayor other than by the recall provisions of the City Charter, the city council shall elect a person to fill the vacant office until the next regular municipal election.
